The Criminal Justice System
Navigating the criminal justice system can be overwhelming. While every case is unique, the process generally involves:
- Arrest, interview and charges: If you are arrested, you have the right to remain silent and the right to legal representation. We can attend the Police station with you and support you through the process.
- Bail application: If you are charged, you may be released on bail or held in custody until a bail application is heard. We can assist in preparing and presenting a compelling bail application.
- Court appearances: You will need to attend court, where the charges will be formally read, and your plea (guilty or not guilty) will be entered.
- Evidence and negotiations: The prosecution will present its evidence. We will review this evidence and explore possibilities for negotiation, such as having charges dropped or reduced.
- Defended hearing or trial: If you plead not guilty, your matter will proceed to a trial, where evidence will be presented and arguments made.
- Sentencing: If you plead guilty or are found guilty, the court will determine an appropriate sentence. This can range from a good behaviour bond or fine to community service or imprisonment. Typically, you will have the opportunity (usually through your lawyer) to present submissions on sentencing, which will include factors for the judge’s consideration in determining a sentence.
