Expert Traffic Defence Lawyers Serving The Hills District and Greater Sydney

A traffic offence in New South Wales can have significant consequences. While many people have received a fine for minor speeding, serious traffic offences carry severe penalties that can impact your work, family and daily life. A conviction or a lengthy disqualification period is more than just a legal hurdle; it is a threat to your livelihood.

At Hughes Law, we provide clear and expert guidance to help you achieve the best possible outcome. Led by principal Belinda Hughes, we offer an insider’s perspective that few firms can match. As the former Head of Prosecutions for Transport for NSW and former National Director of Prosecutions for the NHVR, Belinda understands exactly how traffic cases are built and how to effectively challenge them in court.

Specialist Traffic Law Services

We regularly assist clients with a wide range of traffic matters across Sydney and NSW, including:

  • Drink Driving (PCA): Defending all ranges of alcohol-related offences, from novice and low range to high range prescribed concentration of alcohol (PCA).
  • Drug Driving: Strategic representation for driving with illicit substances in your system or driving under the influence (DUI).
  • Speeding Offences: Defending heavy fines and demerit point allocations, especially for significant margins or school zone offences.
  • Driving While Suspended or Disqualified: High-stakes advocacy for those caught driving without a valid licence to avoid further disqualification or imprisonment.
  • Negligent Driving: Representation for all levels of negligence, from minor incidents to those involving grievous bodily harm or death.
  • Dangerous Driving: Defending serious allegations of driving in a manner dangerous to the public, which carry significant custodial risks.
  • Licence Appeals: Appealing a licence suspension or seeking to have a court-ordered disqualification period reduced.

The Hughes Law Strategic Advantage

Traffic law is a game of technicalities. We win cases by identifying the flaws that others miss:

  • Inside Knowledge: As the person who used to lead the state’s traffic prosecutors, Belinda Hughes knows exactly what evidence is required for a conviction and where the authorities often fail to meet that burden.
  • Technical Challenges: We scrutinise the calibration of breathalysers, the accuracy of Lidar and Radar equipment and the lawfulness of police procedures.
  • The Section 10 Specialist: Our primary goal is often a “non-conviction” order (Section 10). This allows you to avoid a criminal record and, most importantly, keep your driver licence.
  • Proven Courtroom Results: We regularly appear in courts across the Hills District and Sydney CBD, maintaining professional respect with the Magistrates who decide your fate.

What You Need to Know Right Now

  • Disqualification is Often Automatic: Many offences carry a mandatory minimum period. We specialise in finding the legal avenues to bypass these minimums.
  • Your Livelihood is a Factor: If losing your licence means losing your job, we prepare the specific “Extraordinary Hardship” evidence required to sway the court.
  • Early Intervention Works: Completing the Traffic Offender Intervention Program (TOIP) before your court date is the single best way to reduce your penalty. We guide you through this process.

I had the pleasure of working with Belinda for just over a year at Transport for NSW in the Prosecutions unit, collaborating on several projects. Belinda’s ability to juggle multiple projects was unlike any I’ve seen before and this made a dramatic difference in the productivity level of our team. If I had the opportunity to work with Belinda again I would jump at it in a heart beat. She was one amazing leader with so much drive and talent.

I had the pleasure of working with Belinda on a complex and novel project to establish an entirely new national prosecution practice, including its subsequent day-to-day management. This demanding role involved overseeing high-volume summary matters across multiple state and territory jurisdictions, alongside high-profile indictable cases. Belinda consistently delivered with poise, efficiency, and diligence, ensuring outcomes were on time, on budget, and highly effective. She is not only an exceptionally skilled lawyer and enthusiastic leader but also demonstrates genuine compassion for her staff and for the victims of crime. I cannot commend her highly enough.

I’ve had the privilege of working closely with Belinda Hughes during her time as Executive Director Legal at the ICAC in Papua New Guinea, and I can honestly say she is one of the most capable and principled legal professionals I’ve worked with. Belinda joined ICAC during a particularly intense and complex period—helping to stand up a brand-new anti-corruption agency in a politically charged environment. From day one, she brought clarity, structure, and a deep commitment to integrity. Her ability to cut through complexity, provide sound legal advice, and navigate the tricky intersection of law, politics, and public interest has been absolutely critical to our success. What sets Belinda apart isn’t just her technical legal expertise (which is exceptional), but her leadership and calm under pressure. She leads with quiet confidence, is incredibly thoughtful in her approach, and never loses sight of what’s right—even when the stakes are high. Belinda has played a pivotal role in shaping the legal framework of the ICAC, advising on major investigations, high-stakes litigation, and the development of new legislation. She’s also been a steady voice of reason and ethics in some very difficult moments. Anyone lucky enough to work with Belinda will find someone who is deeply intelligent, highly ethical, and completely committed to the public good. She has my full support and recommendation—wherever she goes next, she’ll add incredible value.

        Frequently Asked Questions

Can I get a Section 10 for drink driving?
Yes. For many drink driving offences, especially for first-time offenders with a good driving record, we can argue for a Section 10 non-conviction. This means the court finds you guilty but does not record a conviction or disqualify you from driving.
What is the "Stay" of a licence suspension?
If you lodge an appeal against a police or RMS suspension, we can often apply for a Stay. This allows you to continue driving legally until your matter is heard and decided by a Magistrate in court.
How do I prove I need my licence for work?
We help you gather the necessary evidence, such as employment contracts and letters from employers, to prove that losing your licence would cause exceptional hardship. This is vital for appeals and sentencing.
What happens if I am caught driving while disqualified?
This is viewed very seriously by the courts. It is seen as a direct challenge to a court order. We focus on presenting the subjective circumstances of why you drove to avoid the mandatory jail time that can apply to repeat offenders.
What is the Traffic Offender Intervention Program (TOIP)?
TOIP is a court-recognised safety program. Completing this course before your court date shows the Magistrate that you have taken responsibility and learned from the incident, which often leads to a more lenient sentence.
Should I represent myself in a traffic matter?
While you can, traffic law is a minefield of “automatic” and “mandatory” minimums. A specialist lawyer knows how to navigate these rules to find “discretionary” outcomes that a self-represented person might miss.
